My ex-husband and I owned a business together. When we divorced he bought me out of the business. I have gone back to work for him three times and haven't received payment for the work that I have done. The last time that I went to work for him was at the end of August 2005. I worked a Fri and Sat, a total of 24 hours. The following week I worked 83 hours for a full week. This was also at a location that I had to drive two hours from my home to get to. We hadn't discussed money until I had been there for a couple of days. When we did he finally said that the pay was $700 a week. I told him that would be fine once I was working normal hours but I didn't think that it was fair when I was putting in 15 plus hours a day. I finally wrote up an invoice for work that I had done in June that I never received payment for and for the work I did in August, because again never attempted to pay me. Since he had said $700 a week I took that amount and divided by 40 hours to get an hourly total. I multiplied it by the 24 hours for the first two days I had worked. For the second week when I had put in 83 hours instead of asking for overtime pay I simply asked for $1400. 83 hours is more than a normal two week work week so I figured that it was fair. I didn't not ask for mileage, even though I think that I am entitled to it. He wants to only pay me $140 a day for the eight days that I worked in that location. What am I entitled to? What are my options to get payment for the work I did for him? Please help. my email address is aruskai@tampabay.rr.com.
