Can a company have a policy that only tests certain workgroups that operate machinery and not administrative staff, etc? Is their a chance of racial descrim if the machinery is predominately one race while the office staff is another. I would think it would be justified in that in their position they put the company, others, and themselves in danger when working impaired.

Requiring drug testing of those who perform work such as operating machinery, vs. those on the office staff, is justifiable.
