View Full Version : IL Compensation Exempt vs. non Exempt

Can an employer offer different vacation packages to exempt employees, or custom taylor them for each employee.

Our company wants to hire a guy that is the best at what he does but he demands 3 weeks off of the bat which is different from our policy. I know there are tricky ways to get around this but I was wondering if you can make seperate, or individual vaca policies for exempt employees.

Yes, your employer can, as long as the reason isn't for things such as illegal discrimination on the basis of age, race, relgion, gender, national origin, disability, etc.

You won't find any laws that says an employer is allowed to do this, if that's what you're looking for. In the absence of a law prohibiting something a right is presumed.

The laws cbg is referring to are Title VII, the American with Disabilities Act, and the Pregnancy Discrimination Act, all of which can be found at www.eeoc.gov. You won't find anything there that's directly pertinent to your question though.

By the way, you don't have to do anything "tricky" to get around your own vacation policy. Many, many employers have a standard vacation policy and routinely make exceptions to that when they hire someone. If you want to offer him three weeks of vacation, then just put that in the offer letter.

An employer simply can't hire someone with a substantial amount of work experience in their field and expect him or her to start all over earning vacation - one week after one year, two weeks after two years, etc. I would never accept a new job on those terms.
