View Full Version : Exempt Employee Coming in late

I have a friend who is currently experiencing this situation.

He is a salaried employee scheduled to start at 9:00am. Every know and then he will arrive at 9:03, 9:06: 9:02 (these are documented times).

He is has a job responsibility that requires him to stay anywhere from a half hour to an hour late at least once a week.

He came in at 9:04 today and is otherwise a good employee, they are going to write him up for this. Can they do this? It would seem they could if he was hourly, but being an exempt employee, it just doesn't sound right.

They can write him up for being one minute late. I think it's petty, but it's not illegal. What would be a violation of the Fair Labor Standards Act would be if he was docked pay for coming in late.
