my boyfriend got into a car accident back in the first of may. he and his cousin and friend were all in the car. they were stopped at a red light and it turned green so they started to go. a lady came out of no where, ran the red light, and hit them. they were all hurt. my boyfriend, his friend and his cousin all had to go to the emergency room and were all hurt. my boyfriend had to wear a neck brace and had neck and back problems. he was off work for over a month. he had bills to pay and hospital bills to pay.no one was faulted for the accident. now, the lady is suing him for $25,000. she was in intensive care for a month and a half and broke her hip. does he have a case against her? can he counter sue and win?

He can countersue, but as a practical matter, it may be best for him to let his insurance company handle the defense of the matter as attorney fees can be costly and usually, their representation of the insured and being able to be subrogated in the insured's place is writtn into most insurance contracts and agreements when it comes to claims representation and defense.
