View Full Version : Illinois independent contractor laws re. pay

I am an independent contractor at a spa, therefore paid per massage/facial. The employer demands that all independent contractors arrive at 9:30a.m and leave at closing, appointments or not. This means if I have bookings I get paid, if there aren't any I don't get anything.

The employer also demands that we attend monthly meetings at minimum wage on our off days without a time limit (the last one was 3 hours). There have also been events at the spa and outside events which were mandatory, and again there wasn't any reimbursment.

We have also experienced wage deductions due to coupons and discounts that were mailed, or on the internet. This means 50% less of my regular pay per massage/facial.

NO ONE, as I have come to know, has a signed ind. cont. contract on file, which by the way says nothing of working without pay for marketing purposes, events, etc.
How should these issues be addressed? I was thinking along the lines of starting with legal action...or should I try to get them resolved by demanding a guaranteed rate per service? and back pay?
Any suggestions well appreciated!
