Hello, I am in California and have a question about steps to adoption of my grandson. Let me tell the story. My daughter and her husband were picked up for drugs, my granson taken to child protective services. I got custody of my grandson the next day. Both parents signed guardianship over to me and my husband. Parents are split up and going to divorce. Neither parent is obeying the demands of the court as far as parenting classes to get custody back. Both parents still on drugs. Neither parent has a job or even looking for one. Neither parent has come to see my grandson in over two months. I was told by a lawyer that if no contact was made with the child for 1 year that the parents would lose their rights to him and my husband and I could adopt him. Ok, for the question.... tomorrow is my grandsons birthday. If one of them should get to feeling a little guilty and decide they want to see him would that one visit mean that we would have to start over as far as waiting the year out? Or would one visit in a whole year even count? (Just a little note....I have custody of my daughters other child since he was 2 and he is now 10. At one point she didn't have any contact with him or me for 5 years.)

It sounds like you are getting good advice, so discuss the matter with your attorney. But I think you are jumping the gun on adoption from what you are saying and maybe pursuing legal guardianship would be more appropriate until until no contact goes for over a year.

Thanks for your response. And yes you are right....my husband and I already have legal guardianship. Just wondering about the next step. :)

Well things are pretty much the same. Neither parent has made any attempt to see the child. Neither parent has complied with the court orders to regain custody. In fact both now again have warrants for their arrest. We were told by a lawyer that if no contact was made by the parents for a year that they would lose their rights and we then could adopt him. So that is what we are waiting on now. Thank you for asking! :)
