View Full Version : can employers pay server wages for mandatory meetings?

I am a server at a diner. I was recently scheduled for a manatory staff meeting. The meeting lasted almost 2 hours. When I received my paycheck I noticed that I had not been paid for the meeting. I brought it to my boss's attention. He said I'd be receiving my $6 in my next check. Obviously that would be $3 an hour. Which is close to my server wage, not regular min. wage. Aren't they required to pay us regular min. wage when we are on the clock, not collecting tips, like before open and after close as well as meetings?

Generally speaking, yes, this is a violation of wage and hour law. You must be paid at least minimum wage for all hours worked in which you do not work as a tipped employee, i.e. it is not possible to receive tips when you are not in a position to do so.

However, you can contact your state Dept. of Labor to confirm.
