View Full Version : Two 15 minute break periods

I am in NY state. My daughter recently started a new job fresh out of college. She is paid for a 40 hour work week. Her hours are 8:30 to 5:30 with a 30 minute lunch and two 15 minute breaks. One break in the morning and the other in the afternoon. Should'nt the 15 minute breaks be paid time?Does it matter that they collectively add up to 30 minutes?

Although neither Federal law nor New York law requires an employee to be provided with rest breaks of any length, Federal says that IF breaks are offered, breaks of less than approximately twenty minutes need to be paid. So yes, those two fifteen minute breaks should be paid breaks, UNLESS they are being taken back to back as one 30 minute break.
