My husband works in small business, his verbal preemployment agreement included company paid health insurance. This year when the policy renewed, the premium increase was substantial. The boss commented about the high cost and said we're going to have to do something about this, look at different plans or something and the subject was dropped.
On payday 1/5 of the paycheck was replaced by a note from the bosses wife about our share of the premium. My husband went to his boss and told him we could not survive and if he couldn't pay the premium as agreed we would have to opt for canceling the insurance. The following check was issued by the boss himself and was full and he agreed to reimburse us the money his wife removed. The next 5 checks the wife made the same deduction, each time my husband complained and the boss said he'd give the money back. 4 of the deductions were made after the insurance was canceled. We even have a note from the boss saying he was going to try to staighten out the mess with the rest of the money on Monday, unfortuately that was too many Monday's ago.
Can someone direct me to a law regarding unauthorized payroll deductions? I am familiar with LA R.S.23:635 but I don't know as it applies as this deduction was not a penalty. My husband no longer works for this company and I am preparing a letter of demand for this money and accrued vacation pay and need to be accurate.
