:confused: NY Unemployment Eligibility?

I am a part time employee (30 hours per week) for 4 years and my company is ordering me to work the same job, but at different hours. Unfortunately, I cannot work these different hours because of family situation. If I refuse to work these different hours and am fired, can I collect unemployment? If I quit because I can’t work these new hours, would I be eligible for unemployment?

Also, can anyone direct me to the specific statute in New York that I can look at to back up whatever your tell me!!

I understand whatever information is given to me now is not binding and I cannot solely rely upon it, but I am just looking for a general guideline so I can get an idea of what to expect. Thanks. :confused:

No one but an adjudicator from your state can give you a definite answer as whether anyone will qualify for unemployment is extremely situation and state specific. For the most part the answer to both your questions is no, you would not qualify, but that doesn't mean there may not be circumstances specific to you that might change that. I can't guarantee that there will, but I can't be certain they aren't, either.

No, I cannot point you at a specific statute that says this. If indeed this is statutory and not set up in the adjudicator guidelines, those statutes do not appear to be available on line. I am basing my response on numerous years of experience in this area. What I can do is direct you to the web site for your state unemployment division.
