If you are laid off from a company (non-exempt), and there is an overpayment in your final check, what laws apply regarding this situation...
The monies were deposited directly into my checking account. What is the appropriate correction, if necessary, for this overpayment? I was out of town when the payment was made and due to some "hits" on my personal checking account, and because of the current unemployment status, I am low on the funds to immediately repay. Thanks.

If you received an overpayment, it is your responsibility to repay it. If your employer is willing to work out a repayment schedule, fine. But they are not required to do so. If they want to ask for all the money back in one lump sum, they can.
