I've been looking through this site and reading up on overtime laws in California but I dont get a clear idea on how my overtime works.

I understand anything over 8 or 40 hours in a week is overtime and anything over 12 is double time, and on my 7th day its overtime for the first 8 hours and double time after..well here is my question.

I worked from Monday to the following Wednesday. I'm not too sure what our "defined" work week is but i can guess its either Monday to Sunday or Tuesday to Monday...so I worked each day over 8 hours and 2 days over 12 hours. But if 3 or whatever days fall into a differant "defined" work week do I not get doubletime for those or all day overtime? And if that's so is that just a week part of the overtime law in California? iF you need further information please ask. I would like to approach my employer with a clear explanation and make sure they do something to comp me and the other employers. I'de rather not lose my job because the company goes bankrupt when they get sued.

Until we know what your company has defined as the work week, we cannot begin to answer your question in any depth. Ask your supervisor, or HR, or payroll, then post back.

Well well our time cards are from Sunday to Saturday so I'de assume 12am Sunday to 12pm Saturday.

The "7th day" regulation relates to the seventh day worked in a work week , not seven consecutive work days period. So in order for that particular rule to kick in, you would have have to work each day from Sunday through Saturday. So, you worked 6 days in the first work week (M-Sat) and 4 days (Sun-Wed) in the second work week. So, no 7th day overtime.

So in your opinion is the overtime law in California setup with an obvious loophole so employers can exploit their employees? Just seems wrong that you can work someone 13 days straight and not have the 7th day rule.

I do not form such opinions or, if I do, I do not normally express them here. I am telling you what the law says. My opinion of that law is irrelevant.
