Hello,

I have kinda had some bad luck with my work comp case and I really need some help. This is kind of a long letter, but PLEASE read it.

In March '04 I hurt my back. I had the MRI and it wasn't horrible, but it basically said that I had no disc space in my L4 & L5, my back doesn't hurt, just the sciatic nerve that runs down my leg. I wasn't going to file a comp claim, but my doctor asked me how I hurt myself and I said it was at work, and she put it in my file and the insurance company got to it and I got billed the medical bills, so I got a lawyer.

In October, I won my claim. I went to see a doctor and he said we would try physical theropy and if that didn't work then we would do surgery. In January, after rehab didn't help, he told me that he hoped to have the technology to do the surgery yet and he would get back to me in 6 weeks. About 4 weeks later, I got a letter from my Judge that said the Dr. chose not to do my surgery b/c I was to young. I file for a 2nd opinion but was denied. The dr. released me, I got an FCE and the company is supposed to be finding me a job.

However, in the meantime, my STD ran out and no one told me that I had to file for LTD 6 mos. in advance. I tried talking to my lawyer, but he won't return my calls and his legal asst. said that there was nothing he could do.

I have never received compensation for my 40 lbs. permanent restriction nor have I ever gotten a disability percentage. I am broke, no job, if I take another job the company said that I will lose the 52 weeks left of being an unpaid employee (which means that I can't work there anymore or try to bid on jobs), I can't file unemployment b/c technically I am not unemployed... I just don't know what to do anymore. I am lost and I'm about to lose my truck, house, all insurances, and I got the cut off notice on my electricity yesterday.

Believe me, I want to work. I have been thinking about telling the company that somehow my back is just better and I will take a physical test to go back to work. I am that desperate and that is the only thing that I can think to do, just grin and bear it. Please give me your advice. I would be most grateful!

First of all, I would go to the LTD insurer and ask about appeals. It is hard to believe that there is a six-month approval process but maybe so.

Second, go to the Oklahoma Workers Compensation Enforcement Unit and talk to them about the delay in the settlement. http://www.state.ok.us/~okdol/workcomp/

Third, talk to the workers compensation insurer and ask them the status of your claim.

Hopefully, you'll get some answers soon.

Thank you for your very fast reply. I atleast feel like I have a direction to go in. I will call them all in the morning or make personal visits if I have to. It is nice to know that there is atleast 1 less person out there that isn't against me (besides my mom)!
