My husband was married with his ex in california. At the time they had two cars, just moved to Fallon, NV, and were having marital problems. Well when they divorced they decided they would each get one car. My husband had his car voluntarily reposessed his car a few months ago. To get our finances a little bit in order.
Well back in 2004 of February his ex wife had an accident with a car she had and called him about the accident since his name is on the lien (the contract to pay the car) At the time of the accident the other driver was at fault and there was a police report. We figured it was settled with a claim and the insurance. But my husband was still paying to the Navy Federal people and still waiting on what was happening.
The accident was in San Diego, CA. The insurance the other driver had was 21st century and his ex's insurance was based out of Florida. (They went bankrupt with all the storms. Had to write checks out.)
A couple months ago my husband stopped paying for the car and Navy Federal was going after us and we went to a lawyer because navy federal was sending us letters for legal action. We decided to not take the bankruptcy filing and just decided to take a different approach.
The different approach was to tell Navy Federal we found out the car was in an accident. Since we called about the accident with 21st century they didn't give us any information unless Navy Federal called. They did call for us so they could help us out. We found out no one made the claim on anything from the accident. The operator my husband said she could make a claim because in california you have a certain amount of time to file a claim for a auto accident. THe claim was filed and there was an adjuster we had. We were supposed to hear from the adjuster which we did. THe adjuster we have said it was about coverage he had questions about. THe person on the police report was in 21st century's computer system. The police report only had a partial policy number with the person. Now we find out still it's about coverage. Either that or it is a line of B/S he is feeding us. THe adjuster is taking too long to solve this problem. My husband will paying on a car that doesn't exist still untill the matter is solved. Until a check is cut. The adjuster is also trying to contact the person at fault. Or hear both sides of the story about what happened. Any suggestions on what we should do?????

insurance company should be able to pay you off and invoke subrogation rights to go after the wrongdoer; was that option offered to you? sometimes it reduces a settlement amount but maybe you all need to explore that or consult an accident attorney
