View Full Version : About FMLA/ Pregnancy leave in MI

I am 17 and I am 3 months pregnant. I work for Bed Bath and Beyond, and I am wondering what my rights are as far as maternity leave. I am employed part time and work approx. 35 hrs. a week. I have worked there for 5 months. I am also wondering if they must make exceptions as far as how many breaks I take in a 6 hour period, I am only supposed to be on my feet for short periods of time, but my job requires I am on my feet for 6-9 hours with one 30 minute break. If anyone can help, I would greatly appreciate it. Thanks

You have not worked for the company long enough to qualify for FMLA, and Michigan does not have any state-mandated medical or maternity leave. So you are eligible for exactly the same amount of time that any similarly situated employee with a non-maternity medical condition would be granted, whatever that would be under company policy.

No, being pregnant does not entitle you to more breaks that other employees. Under the Pregnancy Discrimination Act, you are entitled to be treated exactly the same as an employee who is not pregnant. That means you can't be discriminated against, but it also means you don't get special privileges. In the majority of cases, pregnancy is not considered a disability under the ADA so no accomodation is required.

You can certain talk to your employer and ask them whether they would be willing to work with you on these issues, but they are not required to.
