I have accepted a job as an hourly employee working a 9 hour day. I haven't started working yet. I was told we are required to clock in and out when we begin and end our day. I have been told that there are no 1 hour lunches. That the clock subtracts for one 30 min. break. I haven't had to punch a clock for over 20 years, so I have no idea how they can be set to monitor hours worked these days...lol.

My question is... if the clock only allows for one 30 min. break, will I be paid overtime for the extra 30 mins. that I am working? I intend to ask HR for clarification, but want some knowledge before I do.

In the state of Texas overtime needs only to be paid after 40 hours are worked in the scheduled work week. If the don't pay for that, then you can contact your local Dept. of Labor office.

And yes, Time and Attendance systems have made leaps and bounds in 20 years. They can be set up to deduct a standard period for meal breaks. However, if you do not get to take a duty-free meal break, you must also be paid for that time, so make sure your supervisor knows you have worked it.
