My wife is a mental health tech here in Fl. My wife works 6 8hr days in a roll and then off 2 days. I understand that she can be made to work ot but should she paid over time for working the 6 straight 8hr. days. The company says its in different pay periods so they don't have to pay ot. She gets paid every 2 weeks. This is a new change they started. She used to get every other week end with a day off during the week. The pay period used to be Sunday to Saturday. She gets paid every 2 weeks.

Neither Federal nor Florida law requires that she receive overtime for working six days in a row. What the law requires is that she receive overtime if she works more than 40 hours in a single work week.

The law does not dictate what an employer must use as a work week. Though most companies use Sunday through Saturday, they can use Tuesday through Monday, Friday through Thursday, any combination they want.

For ease in understanding, let's say as an example that the work week is Sunday through Saturday. If she works 8 hours a day, Monday through Saturday, then she would be owed OT because she worked 48 hours in a single work week. But if she worked 8 hours a day Tuesday through Sunday, she would not be owed any overtime because 8 of the hours were in a different work week. The fact that the days were consecutive is irrelevant.
