I work for a grocery store as a cashier, am currently pregnant with my second child. Recently my work schedule list’s me as a bagger which means I have to bag customer’s items, carry out and retrieve carts off the shopping lot. I have spoke with my managers severely times about me not being able to handle the baggers requirements because I’m currently pregnant and I also supplied a doctors note. However, for some odd reason the first one was lost and the second one was not detailed enough about what I could not do. I was told that I would not be on the baggers schedule any more this was two months ago. Yet till this day I’m listed as a bagger when I work. I have refused to do the bagger work, am told every time I work that my doctor note did not say I can’t work the bagger requirements. What should I do? I have worked for this company for 4 years now. When I was pregnant with my first child the only note I gave to my boss was a note to seat on a stool. P.S the same manger that was there for my first pregnancy is the same one that’s currently my manger know. Florida

So what DID your doctor's note say?

that I was not allowed to lesft anything over 5 pounds and no bagging.

And your employer is saying that's not specific enough? Seems pretty darned clear to me.
Here's the thing. Your employer is not obligated to comply with restrictions your doctor recommends (although I suggest you talk to your manager about what additional specifics they are looking for from your doctor.) What they DO have to do is treat you no less favorably than a similarly situated employee would be if he or she had similar medical restrictions for reasons other than pregnancy. What you also need to be aware of is that your employer does not have to make up a job for you. If, for example, you can not do the bagger job and no other work is available within your restrictions that you are qualified to perform, they could place you on leave, lay you off, or even terminate your employment depending on what company policy dictates in these circumstances.
It seems to me the place to start here is to talk to your employer and ask what more specific information they would like to see from your doctor regarding what you can and cannot do.

That I understand. The thing I don't get, is that I can work the bakery, produce, floral and other minor things and I’ve did that before.
I’m not a bagger am an office cashier. When I returned from maternity leave with my first child they really didn’t have any office staff position available since they replaced me while I was gone. This was fine with me, because they put me in the other departments? Every so many months the company replaces all store managers. I have the same store manger, but the manger that does the scheduling and her supervisor is new. I spoke with both of them about my situation and they agreed that I would not bag anymore. But once the scheduling (that person that does the schedule) manager went on vacation along with the store manger. She started putting me on the bagger shift. At this point I have spoken to all mangers about my problem with bagging. Know one seems to have a problem with but the person who does the scheduling. She tried to tell that she can put me any where and doctors means nothing basically she was lying to me. I currently go to college and my major is HR and am some what up to date about employment law and the company policy and when I explained that to hers and she just looked at me. Because this is my second child not my first I made sure I know what the policy was. I wanted to know why three different mangers say one thing and she alone says something else. A question she could not answer. So now she avoids me at all cause.
