View Full Version : Family Leave Laws in NY

I am very confused about what laws apply to my situation. I am a resident of NJ but work in NY, so I'm guessing it is NY's labor laws regarding family leave that apply to me.

Here is my situ: Pregnant, working for a small company approx 30 employees. I work full time. My due date is 1 week beyond my 1 year service anniversary at the company. Does FMLA apply to me? Is there another law in NY state that applies to me? Do I have the legal right to take time off? How much? Is any of it paid leave? Is my position safeguarded while I am on leave?

FMLA does not apply since your employer has less than 50 employees.

I'm not where I can look up the state family leave laws easily - if no one else is able to supply them I can check them for you on Friday.

You have the right to take time off if either state law or company policy grants it. How much time you are entitled to take will depend on both factors.

Both NY and NJ have state-mandated disability benefits.

Until I can look up the family leave laws, I can't tell you how much job protection you would have. Since FMLA does not apply, it's going to depend on state laws.

Thanks I would really appreciate the information. I was all over the NY State Labor site and I could not find any clear info on the state laws that pertain to Family Leave laws.
