View Full Version : Do not know if this is Personal Injury or Employment case? New Mexico

A couple years ago my husband was working on the same ranch that I am still working on. The then Manager, basically pushed my husband out of his job which was taking care of the cattle that the ranch had, he said he could no longer use the Ranches truck or trailer because he would be contract labor and the insurance would not cover him. (I do not believe that is true!)He also was only going to give him so much for mileage and use of his own pickup. It was not enough for my husband to be able to do that, so he told them that they would have to find someone else to do the job. The manager took over the job that my husband had been doing by himself with only the help of his dog. The manager was using 2 vehicles, and trailers, and at least 2 other employees besides himself. If he was switching my husband to contract labor to save money for the ranch how could he afford to use twice the help and vehicles? We also have just found out from several people that after my husband left the Manager told them that my husband was no longer working here because of a little matter of some missing cattle!!! These people have said that they are willing to sign affadavits stating what they were told by the manager!

What should we do? People in the area have treated us differently the last couple of years and now we know why, this has hurt my husbands reputation and ability to get a job around here! Surely it is not legal to spread malice and inciminating lies about someone that use to work for you. We have proof of what my husband was doing at the time he was being accused of this. He was selling health insurance and traveling all over the state and out of state. We have all the credit card receipts of when and where he was! The manager no longer works here.

Please help us with any advice you have!

Well it is a tough call because the reputation is damaged in the community and is impacting work opportunity, so that is more of a slander type of action, but there is at-will employment so there does not have to be a reason for his termination but if it is contractual employment with bylaws and employment unless terminated for cause, that is possibly different. Many employers provide no reason for termination because of lawsuits like what may be happening here.

As for the move to contract employment, that probably does impact status in terms of getting benefits and would change to a reimbursement mileage arrangement on travel. But I suggest seeing an attorney that deals more with workplace issues.
