Mid July of 05 my daughter and I were struck while driving through an intersection. I had the green arrow and the other driver had a red light. I am unsure of how fast this driver was going, but my vehicle was totaled. The police report stated that the other driver had inattention and that I had the right-of-way. I had several witnesses there who backed me.

Our injuries included head injuries, severe abdominal bruising, sleeplessness, anxiety, neck pain, arm pain, headaches, depression.... My daughter and I were checked out by a physician and released. The clinic took xray's of me and I am currently seeking the help of a PT. My daughter still gets headaches here and there but the doc said she was fine.

I have terrific insurance who currently is paying my med bills and handling the totaled vehicle expenses. The other insurance co. of the driver who caused the accident has not yet been in touch with me to get my side of the story. My insurance co. stated they would contact them to settle my personal property damage and send a check for the amount of what the vehicle is worth minus my deductible. I had to rent a car for 40 days totaling to over $1,000.00, I am out of a car now because I can not afford to purchase one at this time. The totaled vehicle is still active with my creditor and I am still paying a monthly car payment. HELP!!!

I have an attorney to help me with the personal injury only. I was told not to sign a thing that could potentially settle this case. However, the attorney is never heard from. When I call he is out, when I email he doesn't reply.

Is this confusing???? Anyone with advise that could shed some light on what I should do would be appreciated.

PS. I am in a no fault State (NM) :(

Tell your attorney (or his secretary) that if he doesn't start returning your calls that you'll find a new attorney. If that doesn't do it, then find a new attorney, and come on here and I'll show you how to make a formal complaint with your state bar association against the old attorney.
