My husband gave his employer a two weeks notice last friday. He received a call over the weekend that Thursday would be his last day at work. Tuesday and Wednesdays are his days off. When he went to work on Thursday they had someone already there to replace him.

Can they terminate him after he gives his 2 weeks notice, if the 2 weeks are not up yet? Is he eligible for unemployment?

What can we do?

Yes, the employer can accept the resignation immediately. They are not required to pay out his notice period. He should file for UI immediately, although there may be a 7-day waiting period, so even if he got the benefits, it would probably be for only one week.

If he is going to another job, can he ask the new employer if he could start early?
