View Full Version : Arizona security deposit and withholding for repairs.

What is wear and tear? I know my lease said the security deposit is returned in full less repairs that are not normal wear and tear. If the Landlord should find some thing that I have to pay for out of the security funds, and I request in writing certified mail the items need to be disclosed when the walk through is taking place, and is it okay that tenants ask the LL to have a chance to correct the item to the Landlords satisfaction, if so, legally how many days do I have to repair items?

What about a repairs that were my fault but happened while waiting for some other repair? The circuit switch blew and needed replaced. Before an electrician could come out to replace the switch I had to use an adapter in the light bulb socket of our ceiling fan and run an extention cord from the adapter so that it tangled with the chain used for the ceiling fan light operation I stepped on it, it broke the light switch operation. That would be wear and tear right? It would not have happened if I could use the right outlet.

One more thing. Can the landlord enter premises BEFORE THE WALK THROUGH? I guess she can, but if she finds things to repair and starts the work before our scheduled walk through, what then? I move 9/1/2005.

Again, I cannot answer because it really will depend on your lease. If you disagree with deductions from your security deposit, you should challenge that and may need to challenge that in court if you question the accounting provided. Again, whether the landlord can enter for repairs should be governed by your lease. Most allow that.
i suggest reading the lease and if you have questions, go to a consultation with a local general practice or real estate attorney.

Regardless of what the lease says, the landlord cannot charge for normal wear and tear. As to what constitutes normal wear and tear... hard to say.
