My EX owes over $12 thousand dollars in childsupport. We live in Indiana He hasn't even tryed to see the kids sence a year ago last Easter so 16 months. I don't know how to get him to pay. I have always gone throw the prosacuter, but they get him to pay for a little bit then it stops again. Now it has been sence October sence he has paid anything. He is sitting in the county jail where he lives. (For something else) I have contacted the prosecuter and I was told that they put in a paper to hold child support from his checks. He does have work release. That has been just about 2 months ago and I still haven't seen anything. I can't afford to get a lawyer. I am so fed up! :confused:

Sounds like the prosecutor is representing you. If not, maybe you should have them take your case.

Maybe, I should be glad that they are not telling me that they will get to it someday, but that they have done something. It's just so frustrating. I count my blessings everyday for these children they are some pretty great kids. :)

I am soooo sorry to here that you are having problems. I had the same problem with my sons father. My son is now 20 years old and a father himself and HIS father is still paying me arrears. . . . Has another 10K left to go. I gave up and then about 6 years ago he go married and filed a joint tax return. The first in tax return in years! So, wages garnished, he keep on paying. I happy to hear you say how great your kids are. That just go's to show how GREAT a mother you are!

Talk to the courts and they will work with you.

Thank you! I am going to keep calling going in do what I have to do. My children only have me to stand up for what is theirs and it is only fare to them that he at least pays his part. I love my children so much.

A few days ago I was watching TV and this number came up it is for anyone who is owed $5,000 or more in child support. Maybe if you give them a call they can help...GOOD LUCK...Here is the no...1-800-901-7410 :)

Keep at it! Your tenacity will pay off. It is wonderful that you have so much care to stick up for your children. Our system has many wonderful resources available to help people like you and me out with this kind of thing. Sometimes it just takes a while and can seem like an endless nightmare while it goes on, but eventually there will be some sort of justice.

Does Illinois arrest people who are in great arrears? Maybe that would send him a message.

It takes between 45 and 60 days to get a wage with holding to go through.

What county are you dealing with? Some are better then others here in Indiana.

These places are a ripoff...they get a large percent of anything they can get "for you" and your ex, in turn, could have the CS amount discharged with bankruptcy, inlike if you keep your case with the prosecutors office, and if you turn your case over to one of the collection places, your case is no longer open with the DAs office.(I know most of that to be true, if I am not mistaken, it is all true, the only one I am not sure about is the case remaining open part)

If the procecutors office is this close do not go with that company that collects back child support. I know it is hard to wait because that is all I seem to do. It is so hard when it is so close to start getting the child support. Keep doing what you are doing. Keep somewhat cheerful at least when you talk to the prosecutors office. You will be a squeeky wheel but they will want to help you because you are also being nice.

I am providing you with a link for IN Child Support Profile. It is important that you know your rights and how the system works. I would suggest that you call child support tomorrow and ask them what is going on in your case. If you are not going through child support enforcement, perhaps you should consider this. It is free. Were you sent a copy of the Order to Withhold? Do you know for sure that one was mailed to the employer?
It does take some time for the employer to start the withholding, but after the employer receives an income withholding order or notice, the employer is required to implement income withholding no later than the first payday after 14 days following the date the notice was received. The date by which an employer must remit amounts withheld from an employee's pay is the same time the obligor is paid, your State's procedures for sanctioning employers for not implementing income withholding are subject to contempt of court and there are sometimes fines. There is the penalty to an employer for failure to remit payments withheld.
Please stay away from the Child Support Private Collection agencies. Go through an attorney, pro se or through CSE. Here is a site for Child Support in IN:
