i recently found out my husbands 18 year old daughter just moved back to her grandfathers house(my husbands father). she was raised by her grandparents till her grandmother died when she was 11. now, her mother is still receiving support checks from my husband and as far as i know she still plans to start college in the fall. are we still obligated to make the payments ? if we are can we change the order to have them paid directly to his daughter. we live in ny state.

Are the payments being made after the age of 18 due to your husband being in arrears at one point?

he is up to date. he is paying just the court ordered amount now. its my understanding 21 is the age for ny state when child support will end. unless she is still in college, then it could go to 24.

From what you say, support is still owed, but should it be to the mother or the grandparent since it sounds like the daughter resides with the grandparent. You should seek modification based on the daughter's change in residence to the grandparent since the mother does not have to maintain a home for the child to return to when not in school. Seek a modification of who support is owed to and have the grandparent join in to seek support, and not the mother. I suggest consultation with an attorney given your situation also.
