:confused: I am 4 months pregnant and I started a new job this week. It seems that I am not covered under the FMLA. I am also on the usual 90 day probation. So the big questions are;

Can I be fired or let go for being pregnant?

When should I tell them?

Should I tell them I will take off the smallest amount of time I can after I have the baby?

Will they feel I was dishonest about not telling them when I was hired?

At my age I was advised to wait to advise my employer because of the possible problems with being pregnant at my age of 37.

Please advise

Sincerly

Elizabeth

Your employer cannot fire you solely because you are pregnate. As long as you are able to perform your job, in a nutshell, he must treat you the same way as he would anyone else with a health condition. So, if you are not able to perform your duties, he can discharge you at that time, but not if he grants leave to other people and is treating you differently because of your pregnancy. You are the one to determine when you are no longer able perform your job functions--NOT your employer. There is more to it than just that, but you can learn more on www.eeoc.gov under pregnancy & ADA.
