View Full Version : Forced maternity/medical leave w/o pay

I am currently pregnant with my first child. I both live and work in Georgia. Upon recieving restrictions from my doctor, but not being removed from work, my employeer has decided to place me on medical leave. They feel that my staying on the job would both be a liability to them and myself. They have in the past made arangements for other pregnant women to do light duty work within their limitations. I was told that my disability insurance would pay for 26 weeks, but then recieved a letter stating I would only recieve 6 - 8 weeks after the baby is born. I know in other states that it is illeagal to dismiss an employee from their job without some kind of provisions, and I am wondering what my rights are in georgia as a pregnant working woman. Any help appreciated...

Because your employer was able to provide light duty work to other pregnant employees does not automatically obligate them to do the same for you. It depends what type of job you perform, whether you can perform it with the restrictions your doctor has provided, whether alternative light-duty work is available that you are qualified to perform, and so on. It's also entirely possible that your medical restrictions are more limiting than others have had.

I was told that my disability insurance would pay for 26 weeks, but then recieved a letter stating I would only recieve 6 - 8 weeks after the baby is born. You need to contact your employer and have them explain this to you. While I don't know the specifics of your employer's short-term disability plan, if it's a standard STD plan then you are eligible for benefits if you are unable to perform your regular job due to a medical condition, as certified by your doctor.
