My position as Sales Manager was "eliminated", and at that point I was given option of leaving company or taking a lower paying sales job. I stayed with the company in a sales position.

Two weeks later, the company hired an internal employee to fill the "eliminated" position that I had held for 2 years. His title is Sales Manager.
At one point in Colo. law, (as I understand it), a company could not re-create a position that they had eliminated, for a period of 6 months. Is this still true?
If it is, do I have legal recourse? and how do I go about it?

Thanks in advance for any input!

At one point in Colo. law, (as I understand it), a company could not re-create a position that they had eliminated, for a period of 6 months. Is this still true? That was never true. I don't know why this is but many individuals believe State or federal laws prohibit an employer from reinstating an eliminated job for a specific period of time but that's just not the case.

My hunch is that your employer was not pleased with your performance for some reason and instead of being honest with you about it, went this "job elimination" route instead. If that's the case, they managed the situation very poorly but they didn't do anything illegal.
