"Can my employer hold my paycheck until I return my uniform(s), tools, pager, etc.?
No, an employer cannot withhold or deduct from wages pending the return of uniforms, tools, pagers, or any other employer owned equipment. 56 Ill. Adm. Code 300.830."
"If I quit or am fired, am I entitled to payment for my unused accrued vacation time?
Yes. A former employee has a claim under the Act for the collection of the monetary equivalent of his/her vacation time earned in accordance with an employment contract, agreement or policy. For more information, click here. 820 ILCS 115/5 and 56 Ill. Adm. Code 300.520."
So essentually somebody could quit with no notice a day after they accrue a bunch of vacation time, be paid for it, steal company supplies, cell phone, etc because most employeers will find it too time consuming to file charges to either never get anything back or get back their used or highly damaged property and still cannot hold or withhold from their paycheck. Employeers have to pay out all accrued vacation time. What if an employer offers no vacation time but 2 weeks of sick time a year? Technically in the law "sick" time does nto have to be paid out at termination. Has anybody ever gotten away with that?
Anybody else think this is insane. I've noticed much of the IL Employment Law is very archaic. Is there any grass roots efforts out there to get IL to update?
