I was terminated couple weeks ago by my employer. No advance notice. I was given notice on the day of my termination, which was last day of the month.

Only reason that employer given was some co-workers complained that they cannot get along with me. It was a total setup, management only listen to one side of the story, I was backstabbed by incompentent co-workers.

I was very shock when HR told me that I was terminated, not layoff , and verbally HR said that I was eligible for unemployment payment.

After reviewing EDD handbookk I was shocked to find out that terminate status was treated differently than layoff.

I was employed in CA and in the employment letter, I did recall the at-will clause, but I was discharged not at my own fault I believe and do I have a case to get unemployment benefit?

Thanks, tech-worker

You were terminated for cause...whether you agree with it or not. However, my suggestion to you is that you file an appeal, if you should be denied. The hearing officer may agree to approve your unemployment request if you are able to show that you were not aware of difficulties, etc.

Good luck and let me know if you have any other questions.
