:p My daughter is 15 years old and my husband has custody of her and my son who is twelve years old. My daughter visited me in Chicago and she lives in Mississippi. He attained custody of the kids by placing an ad in the paper and I was totally unaware of a court day or custody hearing. He recieved custody and would not allow me to see my children. The kids do not live with him they live with his 72 year old mother. My daughter was here for three weeks he allowed her to come see me. She got here and did not want to go back. They just allowed me to see the kids in December of last year without supervision. I have never abused my children and I can take care of them. I had to send her back because I was affraid of being arrested in Illinois. She is miserable there and I feel helpless. My son on the other hand wants to stay with his father (grandmother). He has been convinced that I am not good for him and he believes them. The children are not with him because he cannot take care of them. His adopted mother has them and she is 72 years old.
My daughter is unhappy and wants to be with her mother. What can I do to fix this problem?
Is it going to cost alot?

First of all i am sry to hear about your problem. It is too bad that parents have to bad mouth other parents so their children turn against them. I do believe, although i am not positive since you are in a different state than i am, that once a child reaches a certain age you can go to court to change custody if that is what the child would like also. I think that age is 12 or something like that. I would look into it though cause like i said i am not positive. Sry i couldn't be more helpful.

sorry to hear your situation...my stepsister was in similar situation. she was taken from us the same way (at two years old!) eventually my stepmom was able to get visitation and my s.sister always cried when time to leave. Our state law allows children of 14 or older to choose. Went to court immediatly after 14th b.day and she came home for good! that was about 6 years ago. good luck to you!

You need to file a petition to modify custody in the court that issues the current custody order. you will likely need to get a local attorney. You can do it yourself, but it might be complicated.
