North Carolina....well where do i start. i have two childen one who is 8 who lives with me and the other by another man is 3 years old. i lost temp custody os 3 years old to her grandfather (i agree to temp custody after exparte,)pending my recovery. i was using drugs and am now clean for 6 months i have had inpatient treatment, outpatient treatment all the classes and thereapy you can take. i live with my parents for support with my son how misses his sister very much. i get my daughter every weekend at first superivised visits now grandfather agreed to unsupervised visits since clean time and social services closing case on me. i have taken pop drug screens every other week for 6 months now and passed all. i have gone back to school and got my high school diploma, now going to college. i am currently looking for a part time job, i now have a car and bank account. But my problem is that the grandfather now wants to keep my daughter and is going for full custody, his son(the father of my daughter)is still drinking and useing not really in picture.) The grandfather is a convicted felon and has servid time for his crime is also a recoverying addict for drugs. he lives with his girlfriend. Can he keep my little girl does he have a chance?? I just want my little girl back where she belongs with me and her brother. is 6 months long enough recovery time in the judges eyes? Will the grandfathers background hurt him and help me? my poor little girl cries everytime i take her back after a viist says she wants to stay with mommy. Help just need some advice go to court for hearing in less than a month. Have a lawer but dont feel like they are fighting like i want them to. THANK YOU for any input

If you have a job, stable place to live and work, and support, I feel you have a good chance. It may be good if you have relatives you can live with who are positive people that you live with or near them as family support is looked on favorably. I would say that you and Grandpa have an equal chance, but give you the edge as the mother if you can prove that you can provide a stable environment for the kids and an adequate place for them to live. If you are poor, see if Legal Services or Legal Aid group can take your case for free.

well i went to court and got full custody back of my child the only way in nc you can get custody away from the parent is if you can prove them unfit. and past does not matter, it is what you have done to change your life and how it will help you and your chilld. there is justice
