Florida here - I read the earlier thread of the girl worrired about getting married, I too had he same concern about my larger salary - I know now that MY income is untouchable, and I am happily married, despite the usual ***** of an x and drama daily...
however ... please help - I realize that support is based on HIS salary but what about OUR assets? He pays on time, out of his check , so I'm not talking about being BEHIND here, I'm talking about if I inherit money from MY parents?? Is that HIS income and "touchable" for support?
what about joint bank accounts?
if we buy a home?
if mom and dad give US money, as a gift - is that earned income?
do I put it in MY lone account?
what about stocks? :confused: :confused:
Is there a website for the "new " wives or husbands?

Even tho your hubby is current on CS it is always a good idea to keep your finances seperate. You should have your own bank account, even if you also have a joint account. If you inherit from your parents, it is your income-not hubby's. If CS is current you shouldn't have any problems, but it's wise to protect yourself (and your kids, if any) just in case hubby loses job, becomes ill and can't work.

I did get to talk to someone at Florida child support - you're right on! As long as he does not fall behind, (which he never will)
Nothing we own is in jeopardy - NONE of MY income is ever in jeopardy - In fact EVEN if he was behind and we filed taxes jointly , the state can only take half , as half is mine - so those who want to remarry in my situation - you're all good , as long as your man/woman is too!
(and yes , I have my own account and side business in MY name)

If he ever does get behind and his taxes are seized, you would need to file an injured spouse form with IRS, otherwise they would take all the refund. Hopefully nothing ever happens (illness, injury, etc) to cause him to get behind, but as we all know life can sure throw us some curves, so it's always a good thing to know what to do "just in case". :D

you are correct in most of your assumptions but.......................
in any community property state the rules are different Florida is not one of these.
if your husband is proven to be underemployed the courts can and will take your income and joint assets into account (in any state).
as long as hubby works full time in his normal job capacity there would be no basis for the ex to attempt to include your income. (but as i said it has been done before )

Gifts to you are separate property
My suggestion is that you make sure assets are not commingled and that you keep your wages, assets, and property separate. It may even be a good idea to get a postnuptial agreement spelling these things out just to make sure. Consult an attorney to discuss in your local area.
