I need help because someone at work freaked me out. After 8 months of marriage I decided to get a divorce. We both agreed and filed in Feb of this year. I had started a relationship and have gotten pregnant, and it is not my husbands child. I plan on one day marrying my current partner but someone told me at work since I got pregnant as the divorce is going on that if my husband found out he could technically be considered the father--Is this true? We just went into out hearing today for judgement and the question was never asked if I was pregnant. Am I supposed to disclose? I live in California and really need to know. Our divorce should be final in a few months. Does he have any right to anything about this?

If you are still married when the baby is born, your husband is the presumptive father. Presumptions can be overcome with proof. BUt it sounds like you will be divorced from your husband and able to marry the father before the baby is born, or shortly thereafter. So long as you are single or married to the real Dad when your baby is born, you should not have a problem.
