Can some one explain to me what the laws are for someone who i guess is concidered crazy or unstable but they can get away with starting fights with with assault on their neighbors?
I have a friend who keeps getting jumped by a bunch of family members one who is crazy i guess , it turns out that because he has a mental problem or that he is suppose to be on medication that the police say that they can not arrest him unless he shows a knife or gun or another type of weapon, which i could have sworn that fist's were concidered weapons. They constantly start fights with him and then they call the police on him and say he started it when infact I know its them starting because i have seen it numerous times, they had even threathened to kill and beat me up because he was in my apartment and I don't even know these people.

If anyone can give me an insight as to the laws here in West Virginia or know what he can do to have charges filed against them then please let me know

For the mentally ill, they need to be a danger to themselves, or others and the community. My suggestion. Get police reports for each incident to show a pattern. Have others witness the threats and everyone go to make or be part of the police report. If you feel the police are negligent, you can contact the local prosecutor's office and ask them to seek a 24-48 hour on the person for mental health reasons since you are being threatened with imminent physical harm in spite of their mental illness.
