I am a single mother that has been through a rough past but I have made it and have sole physical and legal custody of my 2 year old son the father moved back from florida to california where me and my son have resided since birth he never wanted to take any part in the childs life and now has filed false paperwork in another county stating that he has juristiction becouse he has had my son for 7 monthes this can be diproved however the courts over there have changed a standing order from the county I live in and I dont beleive they have Juristiction but dont know how to handle it.
My main concearn is that the father uses drugs and is a flight risk due to the fact that 3 years ago he left california with our doughter and I couldnt due anything becouse by the time I found them he had resided in florida for over 6 months im scared and do not know all my legal rights nor do I have the money to pay an attoney to help me. He has hired an attorney and filed his head full of all the B.S. and somehow even though he didnt even met the child until the child was 2 1/2 he is trying to get full custody and physical he added that when I visit I not take the child out of the county he resides in. now I have given him supervised visits where I have allowed his mother or sister to be responsible for my son while he was visiting nad my ex is mad becouse he doent want the child with me I already only see my daughter maybe once a month and am taking the steps to get some type of custody now that shes back in california I think that is what set my ex on this mission to take my son from me. I dont understand how a man that knew he had a child on the way and didnt want to participate in the pregnancy give me an address (just called every once in a while to ask if the child had been born)didnt come to see the child for over 2 years never paid anything or bought anything for the child can now say that he is the one he child should reside with becouse he has more money and doesnt struggle like I do. Please if any one has a suggestion or comment respond.

I wonder if you have ever kept everything from your pregnancy bills, receipts of anything you bought for your child, and any hospital bills for your child that you took care of your child. That's how I have everything to make sure I was the one who took care of my child the whole entire time. If he does say you are unfit, don't provide. THat would help you out more. The judge can say you do take care of the child and provide it food and clothing. They will have the dates. He won't have anything. Pictures might help too.

Please if any one has a suggestion or comment respond. Oviously you have a computer...Contact any local Legal Aid Office. You will find that there are many resources for women these days. I once believed that the court could not appoint a legal aid to represent you however today that is not so! First try to make the contact yourself however...if you end up in court before you get help, one of the first questions the judge will ask you is "Do you have representation?" Say "no" and ASK FOR ONE TO BE APPOINTED!!!!! Don't be scared...as the first responder said...Collect everthing you have from pictures, reciepts, friends and family and take it with you to the Legal Aid/Court. He has paid no support? If not, it's another factor in your favor!
Is there a court order supporting your custody of your son? If so, the court that placed that order has jurisdiction. It really sounds like my ex...he's trying to scare amd minipulate you and understate your ability and knowledge to handle the situation. Ask for legal assistance and keep asking if you have too.

Thank you for your feedback I have been researching on my computer the kaws and trying to find a resonable lawyer to help assist me. I do have all my sons medical records and childcare info. I plan to attach them my mtoion to dismiss in the county he resides. in court the judge did not ask me if I was represented nor did they offer he just reviewed the emergency custudy order my ex asked for and modify it.

You need to challenge the jurisdiction of the other court at the first filing and seek a dismissal of their action claiming where you live and the child lives is hte proper jurisdiction for the case since it has been heard there and should continue to be heard there. Alternatively, you should allege that the father has had no contact with the child and no grounds to pursue any action relating to the child given he has abandoned the child.
You need to respond asap. See if you can get attorney help thru legal aid, Legal Services, or a bar association pro bono program if one is available in your area. If not, you can get forms online at websites like uslegalforms.com and or other free legal form websites and look at a form preview to get an idea of how to draft the form yourself.
