Hi. I am in Dallas Texas. A new SVP was brought in and has replaced the management team one by one with people who use to work for him. I am getting a new boss who use to work for this guy. She interviewed with me and my current boss 5 months ago and wasn't hired because she wasn't qualified for a position reporting to me. Also, he hired someone to be my peer and had to get an exception from HR to pay him more than the maximum pay scale to do the same job that I have. Can you file discrimination based on someone hiring all their friends? No job ads were posted; we couldn't apply for the jobs.

It is not illegal to give preferences to those who worked for you in the past, as long as there aren't any illegal discrimiination issues by doing so (with illegal discrimination defined as discrimination based on age, race, religion, gender, national origin, disability and any federal, state and local laws prohibiting discrimination.

Can you file discrimination based on someone hiring all their friends? No. What you describe may be the new boss making some poor decisions on who to hire (only time will tell) but hiring former business associates he's most comfortable working with is not against the law.
