I had a question about Pa Labor Laws. I have recently been fired from my job and I asked my employee for my employee file. They declined. Is there a way that I can obtain this information?

Actually, I'm not altogether sure that terminated employees have a right to inspect their files in PA. It would appear that unless you were laid off with re-employment rights or on a leave of absence, you have to be a current employee.

However, the law specifically states that employees do not have a right to have a copy of your file. Perhaps if you were to modify your request to simply being allowed to see it, they might be willing to permit that.

Because I am curious, I contacted the state. They said that the law is applicable to all employees, even if they were terminated for reasons other than lay-off. However, you must exercise your right within 90 days of termination and, as CBG said, it is for the right to inspect your file. You will need to request permission for a copy. In most cases, employers reserve the right to charge a reasonable fee for copying the file.

Can you also request to see you employee health records? They are the ones written to approve your return to work if out sick more than 3 days? :mad: :confused: :eek:
