I live in Utah and my ex. lives in Colorado. He is $37,000 behind in child support and alimony. The child support order was in Utah and he has since moved to Colorado. Colorado has said that they will suspend his driver's license if he doesn't make a payment by tomorrow. What does that mean? Can he just pay $10 and stop this process. He knows every loophole. He has put their home and vehicles in his wife's name. He says he is renting now but they sold a home in Utah so I really think he bought a new one when they moved.
I have 6 kids still at home. The child support was lowered on one of them when he graduated from high school. The child older than him is handicapped and will live at home for many years. I don't receive any child support for him.
What else can I do? He has filed an order to get child support lowered here in Utah. We go first before the county commisioner next month. He is using the child support money to pay for his attorney and I cannot afford one. For this first court date I think I can handle it but after that I don't know. I won't automatically let him get the child support lowered because he works sporadically and he was making very good money before and still wouldn't keep child support current. I am not trying to be vindictive. I know he will work a lower paying job for awhile or even not have any job just so the child support can be lower. He tried to get the child support lowered almost 2 years ago while he wasn't working saying he couldn't find a job. There were plenty of jobs for him to get. While we were married he would just quit jobs without another one lined up just because he wanted to. He stopped the court proceedings then because I think he knew he was about to be put in jail if he wouldn't get a job. That cost me $500 for nothing. He has had 2 or 3 jobs since then but mostly during those 2 years he has been by choice unemployed. This is very stressful and I really need the money for our children. They have church camps coming up that I need to pay a small amount on but it is tons to me. He never calls the kids or if he sends them letters it is all about him and his new life.
I have the Utah Office of Recovery Services involved and Colorado is helping for their State. My ex. just started a new job 3 months ago. I found out where he was working 2 months ago and immediately gave Utah then info. I still have not received anything. Please help.

It takes time. They likely will not get his new place of employment until they send in tax and employment tapes, which happens quarterly, semi-annually, or annually, depending on the size and type of business and their reporting requirements and how they do business and keep records. As for the disabled child, you should go to court and seek support unless the child is on disability and Medicaid receiving income and has healthcare. If the child is disabled, if you have not done so, the child should apply for disablity and state programs like food stamps, Medicaid, etc... as a disabled adult with you as the payee. Otherwise, it sounds like the system is working. I do not know about his work history to say how that may impact support. The court can use an amount if a parent is voluntarily underemployed, but it sounds like he is doing what he always has his entire working life, so not sure if there is winning argument to be made there. msot attorneys offer free consultation, so you may want to use those to your advantage to get free information. Also, a place like Legal Services may be able to represent the disabled adult child in terms of getting disablity and state benefits, and then in terms of pursuing support from the father if that is still needed.

Thank you for your help. I appreciate you taking the time. We are all so busy and I see you help lots of people. My disable son is getting disability but unlike his Dad he likes to work and keep jobs. I am glad for that. My ex was raised by fantastic parents and a Father that worked so hard. He is still very active at 84 and walks miles several times a week.

First, I would write down everything that you have to pay for those children. The amount and what it is. Take this with you to court and make the judge hear you. I know that is difficult, I am still having troubles with that here, but I found that the more prepared you are for court before you go, the better it will be for you. Don't depend on your attorney to make everything better, research the laws in your state and take notes of EVERYTHING. dates and times. I had to do that with my custody date and it worked much better. I had done all the research for my case and gave it to my attorney, but I also kept a copy for myself. Lawyers are notorious for losing files on their desks. They have seen so many of these cases that some forget why they are there. The lawyer is working for you, remember that.

I live in Utah. I know you can "impute" income. If your ex chooses to be unemployed or "under employed" you can ask the judge to impute his income, meaning that they will base the child support on an income that he is able to make, even if he is choosing to not work or work a job for less money right now. They'll probably use the amount that the support order was first based on. Good luck! I have used ORS also to collect the funds for years and they have been really good, when my ex changes jobs it takes a couple months for them to catch up to him, but they always do.

Well my ex. knows the system. ORS does start prosecuting him and if a couple of payments are made then they stop the prosecution. He then changes jobs or like he just did stops making payments. He made 3 payments for a total of $250. Then he stopped making payments. Because he is an independant contractor Colorado cannot get his income. The payments were not even 1/4th of what he should be paying. He thinks that will keep him out of jail because it worked so many times in the past. I appreciate ORS but it is frustrating because they have guidelines and rules they have to follow. They are for a parent that did actually lose their job or have had problems that really do want to take care of their children. For the others who are deadbeat parents they find and use every loophole there is.
I may before I go to court ask that my ex. pay $20,000 and that will wipe out the rest of the debt or else go to jail. The Judge did say he has no problem sending a deadbeat parent to jail.
I appreciate your advice on imputing income. I will see about that also. He is working right now but like I said before he is an independant contractor so I have to find out what his income is. What a waste of my time. I am so glad that ORS is there. What would we do otherwise?

I am the women who wrote this story about abortion and story about men getting out of childsupport just to show how one sided women seem to think.

Most of the comments came back from all you mad women. I understand you want to be treated fairly but what about men it really is not right we can have abortions or give up our children for adoption and men cannot.

Most of this story is about a man who felt this way about my little girl he wrote this letter to me. He still has not paid childsupport and is working for cash in oakcreek wisconsin. Last I heard he has the horse ranch i always wanted.

I support her on my own and i am proud of that. So always remember I you feel your not getting your fair support how lucky you are to have your child!!!!!!!!!!!

I have known so many women who trap men just for child support so they can
live on it. this is wrong very wrong.

Always remember men and women should have second chances to a life.

I am tsteberl who will not be one sided i have seen both ends.

In court did they request his wife's information? Her might be a factor and the fact that he isn't paying there could be liens put against their home, joint accounts etc.

My ex was given 30 days jail time with it being stayed and has to keep a full time job and cannot quit, get fired or laid off from it. He also has to give me a copy of his pay stub every 3 months and if the state does not take enough money out of his check to cover his obligation then he has to immediately take the rest in to them. He got taken around the jail to show him what it is like also. I was my own attorney and did super. I know this site and people like you helped me get everything ready for this. Thank you again for your help.

Congrats! but you said he was given 30 days in jail or just shown around? I may be going thru similar things in months to come.

I finally have something immediate on my side. To scare him more the Judge had the baliff take him on a tour of a jail cell. It probably was a holding cell because the real jail is about a mile away. Let me know what I can do to help you with going to court. There are some good people on this site also that can help. Good luck! It is scary and stressful but a necessary thing to do.
