I would like to know what the steps are to terminate my parental rights as a noncustodial father in the state of new york. The 2 kids are 12 and 10 and the one kid gets disability from the state of ny on top of child support. Isn't that disability money considered income. I haven't seen the kids in 3 years and don't talk much with them and the mother is married and the kids call him dad from what i have learned. I want to know so i can move on.

As a practical matter, the court will have to issue an order to terminate parental rights, but may not let you since that would result in support being terminated. If the mother agrees, the court probably will, but they may not let you at this point and she may not let you because of the support issue. Also, some states consider payment of child support as contact with the child even if there is no physical or real contact with the child. So you should first ask the mother if she is agreeable to supporting your termination of parental rights petition in writing and if needed, in person, and if she is, contact an attorney to draw one up and file with the court. A hearing will likely be held, but may not be if you both agree to this.
