My husband recently worked for Lokey Auto Group in Clearwater, Florida. He received a weekly draw and then end of the month commission. When he left his job on May 17 he had jobs that were closed in his name that he should have received commission for. To this day we are still fighting to get his final paycheck. Are they breaking the law by not paying him his commission?

Unless he has a written employment agreement saying that the commissions are due should he leave prior to the payment, it is not illegal.

For those sales Rep's constantly getting taken by thier former employers in Florida should take a look at s. 686.201, F.S. This Statute protects the Sales Rep should they not pay commissions due, and if they do not pay within 30 days of termination you can collect 3 times what they owe plus attorneys fees.
