View Full Version : Ohio Hostile Env and Sexual Harrassment

I need to know if I have a case... in 2003 I was sexuallly harrassed by my supervisor.(I am female, he is male). He would stare at me with the lights off at end of day, get too close to me while I was seated at my desk, and then started saying very offensive things to me. Example:I dropped a pen on the floor and he said "ooh get on your knees baby"!! I was filing and "Oooh bend over baby". "You aint no dolly" (dolly parton). When I told a co-worker I was considering going grey (hair color) he said "oh no you wont."
I went over his head, and told his supervisor I was being sexually harrassed. We held a meeting with 4 of us, me, him, his boss and one other female. I was told it would stop and for awhile it did. About 2 months after this meeting, my cable connecting me to the internet was "stolen". (I was always allowed to get on b/c our jobs are seasonal and there are alot of slow times). When I replaced the cable, about 1 week later, he came out and told me I was no longer allowed to use the internet. I did not call his supervisor about it, but was very upset.
In Jan of 2005 another employee there was also harrassing me. He would put his arms around me and generally give me the heebies. In december of 04 I gave all the men gloves for Christmas. This employee gave me a little hug and kissed me on the cheek, but later that day, put his arm around me and got way too close to my face and i told him "dont EVEN try to kiss me" and he said i wasnt going to and went out. A couple of weeks later, he came up behind me and was rubbing my shoulders, putting his hands in my hair, and I'd had enough and flung his hands off of me. Then I wrote a letter to both my supervisor and his and said if this man dosnt stop, we may have to have a meeting with him. My boss yelled at me the next day that "its all YOUR own fault, and you need to learn how to keep your mouth shut ( I had told 1 customer about this harassment). I went over his head yet again, and called his supervisor and told him I need to have a meeting with you.
We had another meeting, I told him that my boss is treating me very disrespectfully, I want it to stop, and I wont be treated in this manner. He promised me they had been working on a policy of sexual harassemnt since Jan 05, and it should be done soon, and Promised he would keep in touch with me to make sure everything is going ok here at our office.
Altho my boss wasnt saying sexually insulting things to me, he would still stare and try to intimidate me, throw work on my desk on top of what I was working on, not help me in the office when we were busy, etc... Then, he started going to the restroom and not closing the door. Our office is very small, and he would do it alot of times when no one else was in there. After weeks of this, I decided when he went to the restroom I would go outside. When that became a hassel, I decided i would walk past and slam the door closed for him. (He would crack the door while pee-ing). So I did that one day, and he came out whistling and all happy about it, knowing he was getting to me. Then I finally called his supervisor. He told me it would stop. I also said to him "you havnt called me like you promised to see how things are going." He laughed and said no, no i havnt. I said "well, im going to tell you, he has been going to the restroom and not closing the door." He said He wont do it again. Here it is June, and still no co. policy on sexual harassment. And just last week, my boss again pee-ed with the door open. Im tired of going over his head and nothing being done about him. Im tired of the way he talks to me like a drill seargent and I believe it all stems from the inital sexual crap and that I wouldnt let him talk to me that way.
On the sites ive been to, there is a limitation of 300 days from the incident. My questions are: do i have a case of hostile wk envrionment? Can the eeoc go back to the original harassement to show these other events are the direct result of the first? Please someone help me. I have had many health problems and stress dealing with this full-time. Thank You!

The time limit is from the date of the latest related situation of harassment. You are within your timeline.

However, in order to make your case "stick", you need to ensure that there are records that you tried to resolve this internally and your request for assistance was ignored (or denied). For that reason, make sure that you put your request in writing, by sending it to your management with a return receipt required. If at all possible, try to do this several times (with the second time occuring after they ignore or discount your request for assistance).

You can then go to the EEOC for assistance, asking for assistance and filing a complaint.

Another item, don't escalate the situation by playing into his hands, in terms of making jeering comments back to him. While you don't want to ignore him, you'll want to make sure that everyone sees that you handled this situation as professionally as possible.
