i read a previous post you given a girl about stagatory rape laws. I am 15 right now my boyfriend is 17, he will be 18 in January and i will be 16 in May. My grandma(gaurdian) said if i get pregnant which i am but she doesnt know yet or if she finds out we are having sex together, which we are, she will press charges. I live in Tn. Will the charges be pressed and proceeded or dropped because of our age.

In Tennessee, the ultimate age of consent is 18, when a person reaches the age of majority. However, a child, at least 13 years of age, may consent to deviate sexual intercourse or sexual contact with another child/person as long as that other person is not more than four years older. No person under the age of 13 may consent to sex nor may a person engage in sexual intercourse with a person under the age of 13.

Since your grandmother is your legal guardian, she has the duty of control and discipline and may delegate who you associate with. If she does not want you to see your boyfriend, she may do so. However, since you are pregnant, you may petition the court to remove your disabilites of minority. You may then make any and all decisions concerning yourself and your child. Also, if you are emancipated, you may apply for a marriage liscense. Until you do so, your grandmother has the right to control what you do and tell you who you can associate with and determine your restrictions and curfews.

As I said before, this does not sound like a prosecutable case given the age difference is less than 4 years. At this point, I think you should explore how to deal with the pregnancy and the child if it is concern to you that your grandmother may try to take custody of the child if you do not want that. You may need to go to the local juvenile court to become emancipated and seek removal of the minor disability to marry or to be a parent with custodial rights. I hope that the family can come around and be preserved. Many churches offer pastoral counseling to assist families in difficult situations like this.
