Let me start by telling you my story,,, I lost my job , had no place to live and 2 young children. I did what I thought was the best thing for my children and asked my mother to take them in until I found a job and an apartment. Granted it took a few years for that to happen but in the mean time my mother and sons father took me to court for custody of my son and the judge awarded temperary custody to my mother. So,,, over the next year my mother went behind my back and went to court and gave custody to my sons father without my knowledge or even being served papers from the court to be there for all this custody exchanging. When I found out it was a week before my son was going to move in with his father and about 3 months too late. Ok my ? is ... Did the court have a right to change custody without my knowledge or even having a chance to be there to stick up for myself or put my 2 cents in? Please help I need to know soon...

Thanks

hard to answer that without seeing the temporary custody order. If that order gave you visitation or any kind of rights, you should have been notified. But if you want to challenge it now, go challenge it and seek an injunction to halt the planned change of custody on the grounds that you were not notified, had an interest, that the arrangement was temporary with the mother to have temporary custody, and this latest change was without your consent, knowledge, that you received no timely notice to go to court to contest the arrangement, and wish for the court to schedule an emergency hearing to seek modification since you have employment and adequate housing for the children. Go do this all yourself asap even if you have to write it out so time does not pass and it becomes too late. It is not too late if this has not happened.
