my husband was hurt on the job in 2002 he injured his shoulder . he was told he had a torn roter cuff. when he went to the dr he was given cortozone shots and sent back to work . on may 5 2005 he went to his family dr who sent him to a specialest and the specialest had my husband do an MRI well he wound up having sugery . My husbands dr was also the dr he was sent to thru workmans comp. So it is on file there that it was work related . My husband went to his family dr on his on and had to file it on fmla for the simple fact workmans comp let him down My Husband never signed a release form with workmans comp . So we were wondering if he would be intitled to a settlement as well as getting payed back for all the money we have spent out of our pocket. Thnx for any info in advance

My suggestion is to hire a workers comp or disability attorney in NC because they would be able to assess your case and most work for a percentage of the back award, so if there is somethign there to be obtained, you should be able to get an attorney to take your case. I also suggest this route because you may not prevail until the appeals process. At this point, I think the biggest issue is time and whether or not you are within the statute of limitations to file for a back award. most attorneys offer free consultations.
