My husband (seperated for 7 years ) has worked under the table so to speak for the past 6 1/2 years so I would not be able to collect support that he agreed upon in our seperation agreement. The few times that I have talked to his lawyer I have been told that our divorce was final and he didn't have to pay me because I didn't allow visitation. I have asked for a copy of the papers because the agreement that we signed stated I have sole physical custody and can allow visitation when requested. HE HAS NEVER contacted me about seeing our son and has only seen him the one time after he was born for about 15 minutes. This is taking time and alot of money to finalize and I just want a real answer.

Your state likely can assist you for free thru the state's attorney or local prosecutor's office child support division. It sounds like going after a private agreement is a joke to him. going thru the state, they will go for support and will use real wages or what wages should be if he is underemployed. Custody and visitation are two different matters, so they do not care if he visits the child and will go after him for support regardless. You can ask for sole custody since he has had no involvement in the child's life and likely get it. Good luck
