my girlfriend is 23 weeks pregnant and is looking to leave work. she has been told by her employer that she will not be granted maternity leave and her insurance will only carry on if she pays for it once she leaves.The employer has tried to get her to reduce the number of days that she works so he can reduce the amount of money he has to pey her.I sshe entitled to any type of compensation for the time that she medically must take off?

1. How many employees work for this company in total?
2. How many employees work at the location at which your girlfriend works and within a 75-mile radius?
3. How long has your girlfriend worked there?

I sshe entitled to any type of compensation for the time that she medically must take off? There is no requirement that your girlfriend be provided with paid leave time, if that's what you're asking nor is there any State-mandate that the employer provide a disability income benefit. If the employer offers a short-term disability benefit and your girlfriend elected coverage when she became eligible, then she would almost certainly be eligible to receive that benefit while she is on leave.

2. 25 at her location and 60 total, there are only 2 locations

in a very related issue, the boss of this company had allowed the other manager's wife to collect some sort of maternity leave/ unemployment pay while she was having a child. not really sure what one it was yet but we are resaerching. if he does not allow this to happen for my girlfriend then we have a pretty open and shut case of discrimination, do we not?

No, you do not. Where do so many people get the idea that all employees, without exception, have to be granted identical treatment in all respects? It would only be illegal discrimination if your girlfriend was not granted the same leave as the manager's wife BECAUSE OF her race, religion, national origin etc. It is quite legal for different classes of employees to receive different benefits.

If there are 25 at her location and 60 total at two locations, you need to tell us how far apart the two locations are. She will NOT be entitled under the law to paid leave regardless of the answer, but depending on the answer she MIGHT be entitled to unpaid leave.
