Okay, it's me again... riddle me this batman...

A co-worker at the restaurant took a picture with his cell phone of his testicles. He showed the picture to two female co-workers in my presence but not to me, apparently he showed it to most of the male staff as well. They discussed it in front of me and made quite a few comments about the picture.

Is this sexual harrassment?

Sounds immature - and it sounds like sexual harassment. However, this isn't yet strong enough to go outside to the state or the EEOC and get serious attention. (In most cases, sexual harassment consists of a pattern of harassment, instead of a single situation.)

Instead, my suggestion is that you go to the management, letting them know that you find it offensive. Ask them to keep your identity confidential, so that you aren't the recipient of retaliation. Though it may not be possible to have complete confidentiality, especially if the investigation becomes more extensive, I would hope that the management will try to handle this appropriately.
