my first 3 years on my H1B expire September 30, 2003. My company has filed for extension around April 2003. It now looks like this extension will not be granted before September 30, 2003 due to long processing times. I have the following questions: - will I be in status after September 30, 2003? What about my I94 if I get stopped by Police or Border patrol?

You will remain in status for up to 240 days past September 30. In the
unlikely event that somebody asks for evidence of your status, the receipt
notice would be the appropriate document. Since your employer rather than
you is supposed to have it, a copy should be enough. In practical terms,
don't worry about it - just carry the old I-94.
- what about my driving licence (expires September 30 as well of course.....)

Not "of course" at all, but some states have indeed started doing that.
You would have to inquire in your specific state about how this situation
is handled.
- My passport will also expire within the next three years. Will INS grant my extension even though they can see on the copy of my passport that it will not be valid for another 3 year period?

INS doesn't approve anything because they no longer exist; it's now BCIS.
They will probably approve the petition for the full three years, but send
you an I-94 that may expire together with your passport.
Thanks very much for your help, my company is not providing me the info I should get (unfortunately not too many jobs out there currently..........). Hopefully one of you out there can help out.
